In India, a Depository Participant (DP) is called a Depositary's Agent. They are intermediaries between custodians and investors. The relationship between the DP and the Depositor is governed by an agreement between them under the Depositary Law. In a strictly legal sense, a DP is a legal entity registered with her SEBI(Securities and Exchange Board of India) under Section 12, Subsection 1A of the SEBI Act. Under the provisions of this law, a DP can only provide depository-related services after receiving a registration certificate from SEBI. As of 2012, 288 DPs from NSDL(National Securities Depositories Limited) and 563 DPs from CDSL(Central Depositories Services Limited) are registered with SEBI.

SEBI (Depositories and Participants) Regulations, 1996 stipulates that if a stockbroker intends to act as a DP with multiple custodians, it must meet the net worth criteria stated separately for each of those custodians. For other categories of DPs, no minimum asset threshold is stipulated. However, depositors may set higher net worth standards for DPs.
