Yes, your brother can definately apply for the admission in NIOS class 12th. The eligibility criteria for the candidate to apply in NIOS for class 12th is the candidate should have passed their class 10th from a recognized board and the minimum age of the candidate must be 15 years. Therefore it dosen't matter if your brother have failed class 12th, he can apply for the admission.
