The major difference between fundamental right and directive principles is discussed below:

Fundamental rights:

  • Borrowed from the constitution of the U.S.A.
  • Defined under Part III under articles 12-35.
  • Justiciable
  • Negative in nature, as it opposes the government not to do certain things.
  • Establishes political democracy.
  • They are legal sanctions.
  • Promote the welfare of the individual.

Directive principles:

  • Borrowed from the constitution of Ireland.
  • Defined under Part IV under articles 36-51
  • Non- justiciable
  • Positive in nature.
  • Establishes social and economical democracy
  • They are political sanctions.
  • Promotes the welfare of a community.

These are the most important differences between the fundamental rights and directive principles.

Fundamental rights equally apply to all citizens of the country irrespective of their race, caste, creed, sxx, religion, place of birth etc. Violation of the fundamental rights is a punishable offence under the Indian Penal Code (IPC) . The fundamental rights as recognised by the Indian Constitution are:

  • Right to equality
  • Right to freedom
  • Right to freedom of religion
  • Right against exploitation
  • Cultural and educational rights
  • Right to constitutional remedies
  • Right to education

These are negative in nature and prevents the government to do certain things or take certain actions.



The directive principles follow the basic philosophy of the Constitution of India like an overall development of the nation, social justice, economic welfare, foreign policy etc.  The violation of directive principles is not a punishable offence . They cannot be enforced in a court of law.

These are positive in nature and requires the government to do certain things.
