40% marks do not make you eligible to apply for CLAT exam. You need at least 55 percent in your qualifying degree if you're a general candidate. In case of reserved category, a candidate requires 50% marks in class 12. For more on CLAT eligibility, read below:

Eligibility for CLAT:
Candidates should have passed Senior Secondary School Examination/ 12th Board Examination from any recognised educational institution.
Candidates need to score atleast 45% marks in their qualifying degree to appear in CLAT 2019. For the candidates belonging to SC and ST categories need to score at least 40 percent marks in the aggregate of subjects.
