I was studying in class 12 with commerce stream from CBSE board but i left in the mid of year (2022). Can i eligible for JEE advanced by repeating class 12 with PCM from the NIOS board (2023)? Is it legal or not?

Yes! You will be eligible for JEE as the eligiblity to appear for jee is you should have passed class 12th with Minimum of 75% for general catagory and 65% for other reserved catagory. It is not at all mentiond in the eligiblity criteria if you have failed the exam and reappeared or you must complete it from any specific board. All you need to have is a class 12th pass certificate. But do remember the other eligiblity criteria as well such as minimum percentage which I have already mentioned above and age requirements, maximum attempts etc. I wish you all the best for your jee preparation journey, you'll surely ace the test.
