If a legal complain is filed against a student for using EWS certificate in JEE mains and it is found that the guardians of student are not paying taxes. That's why they have EWS certificate. Will the student be disqualified from JEE Mains or not?

First of all EWS certificate or eligibility depends on family income if your family annual income is above 8 lakh it cannot be considered as economically weak and hence cannot fall under the economically weaker section (EWS).you cant claim EWS category seats.

For disqualification they just ask you for EWS certificate at the time of document verification if you are unable to produce the certificate your seat get cancelled thats it there is no legal action taken by thm dont worry.

If the student's guardians are not paying taxes , it may support their claim of being economically weaker, as non-taxpayers can fall under the EWS criteria if other conditions are also met.

However, if the EWS certificate was legitimately issued by the appropriate authorities based on valid income criteria and legal guidelines, and the student is found to be within the eligibility limit (income below Rs. 8 lakhs per annum) , then the student would not be disqualified .

But if it's found that the certificate was obtained fraudulently or the student/guardians misrepresented information on the certificate, the authorities could take action. This might include:

  1. Cancellation of the EWS certificate .
  2. Disqualification from the JEE Mains exam process.
  3. Possible legal consequences for submitting false information.

The decision would depend on the findings of the investigation and legal process.
