Most schools, will refuse to admit such a candidate in their rolls because there's an option of Improvement exam as a Private candidate already. And there's no reason why someone would not opt for repeating by attending school again.

However, you can successfully try dummy schools for sure. Here, in NIT, many come from dummy schools, and they have no inhibitions enrolling them, but just that you got to pay a little higher fees than usual. And you won't have to go to school, round the year in either case.

The only difference, between reappearing through Dummy school or as a Private candidate is, in Improvement mark sheet, the school name will mentioned in former's case while for the latter it'd be written "Private candidate" . And that dosen't matter after all.

So, basically it's not illegal in any case. Just that, you got to find the right school which will be ready to act as a dummy one. In case, she wants to "Attend" a year again, and a different school well this'd be hard nut to crack. Not many schools, want to accept such students.
