Article 300A stipulates that an individual's property cannot be taken from them unless legally authorised. Following the passage of the 44th Constitutional Amendment Act in 1978, the property right was removed from the list of fundamental rights. Following the amendment, it was granted legal standing under Part XII of the Constitution, Article 300A.
