Well even with 40k rank it is certainly possible that you will just make it barely into some of the nits. If you apply for home state quota I guess you will certainly qualify for some branches that are less in demand such as textile, food processing, integrated MSC, material science and  metallurgy etc.

So, it's your decision to go for some better nit with your home state quota.

In order to get the rank below 40000 you have to score minimum 97.33 percentile in JEE mains and more than the mentioned percentile score. A link is attached where you can see the table showing the closing and opening percetile along with the rank so that you can have the better idea about the ranking in JEE and also you can find out more information about the JEE rank and percentile.
